Legal DMCA Policy

Dispatch FM, LLC ("Dispatch") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), Dispatch will respond to valid notices of copyright infringement involving content hosted on or transmitted through the Service.

This policy describes how to submit a takedown notice, how an affected user may submit a counter-notification, and our repeat infringer policy.

1. Designated Copyright Agent

All DMCA notices and counter-notifications must be sent to our Designated Copyright Agent:

We strongly recommend submitting notices by email for faster processing. Notices submitted through channels other than those listed above may not be acted upon.

2. Submitting a Takedown Notice

If you believe that content on the Service infringes your copyright, please send a written notice to our Designated Copyright Agent containing all of the following elements required by 17 U.S.C. § 512(c)(3):

  1. Identification of the copyrighted work — Describe the copyrighted work you believe has been infringed. If multiple works are covered by a single notice, you may provide a representative list.
  2. Identification of the infringing material — Identify the specific content on the Service that you claim is infringing and provide sufficient information for us to locate it (e.g., a direct URL or episode title).
  3. Your contact information — Provide your full name, mailing address, telephone number, and email address.
  4. Good faith belief statement — Include the following statement: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  5. Accuracy and authority statement — Include the following statement: "I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
  6. Signature — Your physical or electronic signature.

Upon receipt of a complete and valid notice, Dispatch will act expeditiously to remove or disable access to the allegedly infringing content and will notify the user who uploaded that content.

Warning: Knowingly submitting a false DMCA notice is a violation of 17 U.S.C. § 512(f) and may expose you to liability for damages, including costs and attorneys' fees.

3. Counter-Notification Procedure

If you believe your content was removed as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. A valid counter-notification under 17 U.S.C. § 512(g)(3) must contain all of the following:

  1. Identification of the removed material — Describe the content that was removed and its location on the Service prior to removal (e.g., the URL).
  2. Statement under penalty of perjury — Include: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  3. Your contact information — Your full name, mailing address, telephone number, and email address.
  4. Consent to jurisdiction — Include: "I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, the United States District Court for the District of Delaware, and I will accept service of process from the person who provided the original DMCA notice or their agent."
  5. Signature — Your physical or electronic signature.

Upon receipt of a valid counter-notification, Dispatch will forward it to the original complaining party and inform them that the removed content may be restored in 10–14 business days unless the copyright owner files a court action seeking to restrain the allegedly infringing activity. If no such action is filed within that period, Dispatch may, in its sole discretion, restore the content.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Dispatch maintains a policy of terminating, in appropriate circumstances and at Dispatch's sole discretion, the accounts of users who are deemed to be repeat infringers. Dispatch may also, at its sole discretion, limit access to the Service or terminate the accounts of users who infringe any intellectual property rights of others, whether or not repeat infringement occurs.

A "repeat infringer" is a user who has been the subject of two or more valid DMCA takedown notices within any 12-month period, or who Dispatch otherwise determines has a pattern of infringing the intellectual property rights of others.

5. Modifications
